The 7-to-14 Day Rule (and What You Must Do After a Major Rain Event)
A SWPPP is not a document you can simply approve, toss into a job trailer binder, and forget until the project is finished. The EPA’s Construction General Permit (CGP) requires ongoing, documented vigilance.
If your site is audited, the very first thing an inspector will ask for is your inspection log. If there are gaps in your timeline, you will be fined—even if the sun has been shining and your site looks pristine. Here is how the federal inspection cadence works and why rain changes everything.
The Standard Cadence: 7 or 14 Days
Under most standard permits, you have two options for your routine operator inspections:
Once every 7 calendar days.
Once every 14 calendar days, PLUS within 24 hours of a qualifying rain event.
Most municipalities prefer or require the 14-day schedule because it forces you to check the site immediately after the weather tests your defenses.
The "Qualifying Rain Event" Trigger
What counts as a "qualifying rain event"? Under the federal CGP, it is typically defined as a storm that produces 0.25 inches or more of rain within a 24-hour period (though some local municipalities have even stricter thresholds).
When that amount of rain hits, the clock starts ticking. You have exactly 24 hours to walk the entire site, assess how your Best Management Practices (BMPs) held up, log any failures, and initiate repairs. If it rains on a Friday night, your superintendent needs to be walking the site on Saturday morning.
The Heavy Burden on Project Managers
Tracking the local weather, measuring rainfall on the site, and dropping everything to conduct an emergency inspection is incredibly disruptive to a project manager's schedule. If they miss the 24-hour window because they were dealing with a material delay or a subcontractor dispute, the site is legally out of compliance.
