State NOI Permit Application Filing

​​NOTICE OF INTENT (NOI): Prior to issuance of the Stormwater Permit, a NOI must be submitted to the State. Submission of a NOI constitutes notice that the Operator intends to be authorized by the State to discharge storm water associated with construction activity.

Accena Permit Service: For an additional fee of $350, we will complete your NOI application and prepare it for submission.  This preparation fee does NOT include the permit fee required by the State. State permit fees vary by project.

Operators are responsible for implementing and maintaining best management practices (BMPs) to control stormwater runoff and prevent pollution during construction activities. They must ensure compliance with the stormwater pollution prevention plan (SWPPP). Typically, this would be the project owner, developer, or general contractor.

The project manager is responsible for Construction, BMP installation and Maintenance, Training of onsite personnel, SWPPP preparation and approval of amendments, and inspections. The project manager will be listed as the emergency contact for the site.

Permanent Stabilization includes things like Landscaping and/or Paving the site so that soil is no longer disturbed.

Projects disturbing over one (1) acre or that are part of a "Common Planned Development" (subdivision) require inspections by an inspector certified by the State or EPA. NOTE: The City/County/State official inspections are different than the inspections required by the Stormwater Permit and do not meet this requirement.

The operator signatory requirements need to be added as well, correct? SECTION 9.9 – CERTIFICATION 9.9 SIGNATORY REQUIREMENTS All applications, reports, or information submitted to the Director shall be signed and certified. 9.9.1 All Permit applications, including NOIs and NOTs shall be signed as follows: For a corporation: By a responsible corporate officer. For the purpose of this section, a responsible corporate officer means: a president, secretary, treasurer, or vice-president of the corporation in charge of a principal business function, or any other person who performs similar policy or decision-making functions for the corporation; or the manager of one or more manufacturing, production or operating facilities, provided the manager is authorized to make management decisions which govern the operation of the regulated site including having the explicit or implicit duty of making major capital investment recommendations, and initiating and directing other comprehensive measures to assure long term environmental compliance with environmental laws and regulations; the manager can ensure that the necessary systems are established or actions taken to gather complete and accurate information for Permit application requirements; and where authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures. b. For a partnership of sole proprietorship: By a general partner or the proprietor, respectively; or c. For a municipality, State, Federal, or other public agency: By either a principal executive officer or ranking elected official. For purposes of this section, a principal executive officer of a federal agency includes: The chief executive officer of the agency, or A senior executive officer having responsibility for the overall operations of a principal geographic unit of the agency (e.g. Regional Administrators of EPA).
